Please read these Terms of Service carefully before using our website or booking our services. By accessing expressmobilediagnostics.com, book.expressmobilediagnostics.com, or scheduling any service with Express Mobile Diagnostics, you agree to be bound by these terms.

1. About Express Mobile Diagnostics

Express Mobile Diagnostics ("EMD," "we," "us," or "our") is a mobile testing services company based in Central Arkansas. We provide certified mobile drug testing, legal DNA testing, and employer compliance programs. Our services are delivered at the client's location throughout the Central Arkansas region, including Little Rock, North Little Rock, Conway, Benton, Jacksonville, and surrounding communities.

and any services you schedule or receive from us.

2. Eligibility

By using our websites or services, you represent that:

  • You are at least 18 years of age, or are a parent or legal guardian scheduling services on behalf of a minor
  • You have the legal authority to enter into this agreement
  • You will provide accurate, complete, and current information when booking services
  • You are located in or scheduling services within our service area

3. Services Offered

Express Mobile Diagnostics offers the following services:

  • Mobile Drug Testing: 5-panel, 10-panel, DOT-compliant, rapid, and specialty drug screens conducted at your location
  • Legal DNA Testing: Court-admissible paternity testing, immigration DNA testing, prenatal DNA testing, and family relationship testing
  • Employer Programs: Pre-employment screening, random testing pool management, DOT compliance programs, post-accident testing, and ongoing compliance management

All testing is conducted by certified collectors using SAMHSA-certified laboratories. Results are processed and delivered in accordance with applicable federal and state regulations.

4. Booking and Appointments

When you submit a booking request through our website or by phone:

  • Your submission is a request, not a confirmed appointment. Appointments are confirmed when you receive direct confirmation from EMD via your preferred contact method.
  • We will contact you within 2 business hours of receiving your request during normal business hours.
  • You are responsible for ensuring that the testing location is accessible and that all required participants are present at the scheduled time.
  • Pricing shown on our website is an estimate. Final pricing will be confirmed at the time of appointment scheduling.

5. Cancellations and Rescheduling

  • Cancellations made at least 24 hours before a scheduled appointment will not incur a cancellation fee.
  • Cancellations made less than 24 hours before a scheduled appointment may be subject to a cancellation fee of up to $50.
  • No-shows without prior notice may be charged the full service fee.
  • EMD reserves the right to reschedule appointments due to collector availability, weather, or other circumstances beyond our control. We will provide as much advance notice as possible.

6. Payment

  • Payment is collected at the time of service, not at the time of booking.
  • We accept cash, major credit cards, and approved employer billing arrangements.
  • Employer accounts may be invoiced according to agreed billing terms.
  • All prices are in U.S. dollars.
  • Pricing is subject to change without notice. The price confirmed at the time of your appointment scheduling is the price you will be charged.

7. Accuracy of Results and Limitations

EMD uses SAMHSA-certified laboratories and follows strict chain-of-custody procedures. However:

  • No testing method is 100% infallible. Results are subject to laboratory analysis and may be affected by individual biological factors, medications, or other variables.
  • EMD is not responsible for the consequences of test results, including employment decisions, legal proceedings, or personal matters.
  • Positive results may be subject to Medical Review Officer (MRO) review as required by applicable regulations.
  • DNA test results reflect the analysis performed by our accredited laboratory partners and carry the accuracy rates stated by those laboratories.

8. Client Responsibilities

You agree to:

  • Provide accurate personal and location information when booking
  • Ensure all participants are present and prepared at the scheduled time and location
  • Provide valid government-issued photo identification for all participants when required
  • Cooperate fully with our certified collector during the collection process
  • Not attempt to adulterate, substitute, or otherwise tamper with any specimen
  • Notify us of any medical conditions or medications that may affect test results

Specimen tampering or refusal to cooperate with collection procedures may result in a reported refusal, which may carry the same consequences as a positive result under applicable regulations.

9. HIPAA and Confidentiality

Express Mobile Diagnostics handles all personal health information in compliance with the Health Insurance Portability and Accountability Act (HIPAA). Test results are confidential and will only be released to:

  • The individual tested (or their legal guardian)
  • The employer or authorized third party who ordered the test, as permitted by law
  • Medical Review Officers as required
  • Courts or regulatory agencies as required by law

We do not sell, share, or disclose your personal health information for marketing or commercial purposes.

10. Intellectual Property

All content on our websites, including text, graphics, logos, images, and software, is the property of Express Mobile Diagnostics or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our express written permission.

11. Disclaimer of Warranties

Our websites and services are provided "as is" and "as available" without warranties of any kind, either express or implied. EMD does not warrant that our websites will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information on our websites.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Express Mobile Diagnostics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our websites or services, including but not limited to loss of profits, data, or goodwill, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid to us for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Express Mobile Diagnostics, its officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be resolved in the state or federal courts located in Pulaski County, Arkansas, and you consent to the personal jurisdiction of such courts.

15. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to our websites. Your continued use of our websites or services after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and Express Mobile Diagnostics regarding your use of our websites and services, and supersede all prior agreements and understandings.
